Quick answer

What you need to know

An early move-out is safest when you review the signed lease, calculate every cost, negotiate a written termination agreement, document the property's condition, and close address and utility records deliberately.

  • Read the signed lease and amendments before proposing an exit date.
  • Calculate rent, deposit, agency, utility, repair, and replacement-tenant costs together.
  • Do not rely on a verbal promise that the deposit will be returned.
  • Use a signed handover record with meter readings, keys, photos, and payment dates.
  • Update accommodation registration and other address-linked services after moving.

A job transfer, family change, building problem, or unexpected departure can make a fixed-term lease impractical. Moving out early, however, does not by itself end the contractual obligations. The cleanest exit is a written agreement that settles the date, money, property condition, utilities, and keys.

This guide is general information, not legal advice. Contract terms and local rules differ; obtain qualified advice when the amount or dispute is significant.

1. Read the documents you actually signed

Gather the lease, bilingual version, amendments, inventory, condition report, agency agreement, deposit receipt, rent-payment record, and landlord contact details. Identify clauses on notice, early termination, breach, liquidated damages, subletting, replacement tenants, deposit deductions, repairs, and dispute resolution.

If language versions differ, do not guess which wording controls. Ask a qualified adviser or translator to review the relevant clauses.

2. Calculate the whole exit cost

Make a settlement worksheet covering:

  • Rent through the proposed handover date
  • Contractual early-termination amount
  • Deposit and proposed deductions
  • Unpaid utilities, property fees, internet, or parking
  • Damage beyond normal use
  • Cleaning or removal agreed in the lease
  • Agency or replacement-tenant fees
  • Refundable prepaid rent or services

Keep contractual obligations separate from negotiable requests. This makes the conversation more precise.

3. Propose a practical solution in writing

Contact the landlord early. Explain the requested date, cite the relevant clause, provide a clear proposal, and ask for a written response. Possible negotiated solutions include an agreed fee, a later move-out date, continued rent until a replacement begins, or assistance finding an approved replacement.

Do not assume silence means consent.

4. Handle replacement tenants carefully

If the landlord permits a replacement, agree who advertises, screens applicants, pays agency fees, signs the new lease, and receives money. The incoming tenant should contract directly with the authorized landlord unless a lawful and documented alternative has been approved.

Avoid informally handing over keys or collecting a deposit without clear authority. Unauthorized subletting can create new problems instead of ending the old lease.

5. Sign a termination agreement

The document should reference the original lease and property, name the parties, state the final occupancy and handover dates, list every payment or refund, specify the deposit-return date and account, allocate utility and repair costs, and confirm what obligations remain afterward.

Make sure the person signing for the landlord has authority. Keep a signed copy and payment evidence.

6. Conduct a documented handover

Clean as agreed, remove belongings, photograph each room and appliance, record utility meters, test keys and access cards, and compare the inventory. Use a signed handover sheet listing condition, readings, keys, agreed deductions, and outstanding payment dates.

7. Close services and update the address

Confirm final bills for electricity, water, gas, internet, property management, parking, and any recurring delivery or household service. Retain proof that accounts are paid or transferred.

After moving, complete the required accommodation-registration process for the new address and update relevant records. Use Updating Your Address After Moving in China as a service-by-service checklist.

Early termination checklist

  • Lease, amendments, inventory, and receipts collected
  • Notice and termination clauses reviewed
  • Total exit-cost worksheet prepared
  • Written proposal sent to landlord
  • Replacement-tenant authority documented if applicable
  • Termination agreement signed by authorized parties
  • Photos, meter readings, keys, and handover form completed
  • Deposit return date and payment account recorded
  • Utilities closed and new address registration handled

If agreement is difficult

Keep communication factual and preserve all messages and receipts. A local housing or legal adviser can assess the lease and available dispute route. Do not withhold property, change locks, stop payment, or sign a release solely on informal advice; first confirm the consequences for your specific contract and city.

Frequently asked questions

Common questions

Will I automatically lose my deposit if I leave early?

Not necessarily, but the result depends on the signed contract, facts, and any negotiated agreement. Ask the landlord to itemize the proposed settlement in writing.

Can I find a replacement tenant?

Only with the landlord's written agreement and a clear process. Do not advertise, sublet, collect money, or hand over keys without confirming what the contract and landlord permit.

Should I stop paying rent and use the deposit instead?

Do not assume the deposit can serve as final rent. Follow the contract or a written settlement so unpaid rent does not become a separate dispute.

What should the termination agreement include?

It should identify the property, original lease, agreed end date, payments and deductions, deposit-return timing, handover standard, utility responsibility, keys, and release of remaining obligations.

What address records need updating?

After moving, promptly check accommodation registration and any bank, employer, school, insurance, delivery, vehicle, or other records linked to the old address.
