Quick answer
What you need to know
Start the deposit-return process before moving day: read the contract, give notice in the required form, document the home's condition, settle agreed bills, and obtain a signed handover record. If money is withheld, request an itemized written explanation and use the contract's dispute route.
- The signed lease and documented handover condition are the starting points for any deposit discussion.
- Photograph meter readings, rooms, appliances, keys, and repaired damage before surrendering access.
- Do not rely on a verbal promise; record the refund amount, deductions, account, and deadline in writing.
- For a disputed amount, seek local legal advice before signing a broad release or abandoning a claim.
Recovering a rental deposit is easier when move-out is treated as a documented handover rather than a last-day conversation. The lease, notice history, inventory, photos, bills, and signed settlement should tell one consistent story.
This guide provides general planning information, not legal advice. Rental practices and dispute procedures vary by contract and city. Confirm material questions with a qualified local lawyer or the relevant housing and dispute-resolution authority.
Read the exit clauses before giving notice
Find the sections covering the lease end date, early termination, notice method, restoration, cleaning, utilities, deposit deductions, key return, and dispute resolution. Check whether the agreement requires notice through a particular channel or number of days in advance.
If you are leaving early, do not assume finding a replacement tenant automatically ends your obligations. Ask the landlord to sign a termination or transfer agreement stating the effective date, remaining rent, deposit treatment, and responsibility for agency fees.
Our moving apartments guide covers address changes and logistics; this article focuses on closing the old tenancy cleanly.
Build a move-in-to-move-out evidence set
Locate your original inventory, check-in photos, repair messages, rent receipts, and proof of deposit payment. Then make a new photo and video record in daylight. Capture:
- every room, wall, floor, window, and fixed fitting;
- furniture and appliances from several angles;
- existing scratches, stains, leaks, or broken items;
- water, electricity, and gas meter readings;
- cleaned kitchen and bathroom areas; and
- all keys, cards, remotes, and access devices.
Keep original files with timestamps. If an appliance failed during the tenancy, pair the photo with the message showing when it was reported. The landlord repairs guide explains how to maintain that record.
Agree on bills and deductions
Ask the landlord or agent which final bills must be settled and how prepaid utility balances will be treated. Save payment screenshots, invoices, and final readings. Cancel or transfer services that are in your name; use our utilities move-out guidance as a starting point.
For each proposed deduction, request:
- the contract clause relied upon;
- a description of the damage or missing item;
- supporting before-and-after photos;
- an invoice, quote, or other cost basis; and
- confirmation that ordinary aging is being distinguished from tenant-caused damage.
Do not sign a document you cannot read. Ask for a translation or independent review if a settlement waives claims or states that all funds have already been received.
Complete a signed handover
Walk through the apartment together where possible. Use a bilingual handover sheet listing the date and time, property address, condition, readings, returned items, unresolved issues, agreed deductions, refund amount, payment account, and deadline.
Both sides should sign or otherwise clearly confirm the same version. Photograph the keys at the moment of transfer. After surrendering keys, avoid entering again without permission.
Escalate a delayed or disputed refund carefully
First send a concise written request that cites the lease and signed handover, states the amount due, provides payment details, and gives a reasonable response deadline. Keep the tone factual.
If that fails, review the contract’s mediation, arbitration, court, or other dispute clause. A local lawyer can assess the evidence, jurisdiction, limitation periods, and whether a formal demand is proportionate. Government service hotlines or local mediation channels may provide procedural direction, but they do not replace advice for your case.

Frequently asked questions
Common questions
When should a landlord return a rental deposit in China?
The lease may set the timing and conditions. Confirm the agreed deadline at handover and ask the landlord or agent to record it in the signed settlement statement.
Can a landlord deduct cleaning or repair costs?
That depends on the contract, the property's documented condition, and the reason for the charge. Ask for an itemized explanation, photos, and receipts rather than accepting an unexplained lump sum.
Should I stop paying the final month's rent and use the deposit instead?
Not unless the landlord agrees in writing. A deposit and rent may have different contractual purposes, so unilateral offsetting can create a new dispute.
What if the agent and landlord give different instructions?
Ask who has authority to accept handover and approve the refund, then put all parties on the same written message or settlement document.
